Methods of discipline, interaction or toilet training which frighten, demean or humiliate a child are prohibited.Īny abuse or maltreatment of a child is prohibited. For the purposes of this Subpart, the term corporal punishment means punishment inflicted directly on the body including, but not limited to, physical restraint, spanking, biting, shaking, slapping, twisting or squeezing demanding excessive physical exercise, prolonged lack of movement or motion, or strenuous or bizarre postures and compelling a child to eat or have in the child's mouth soap, foods, hot spices or irritants or the like. Enforcement action will remain “pending” until a final decision has been rendered by an administrative law judge or by a court, or until the enforcement action has been resolved. Suspension will continue until OCFS has determined that the condition requiring suspension has been corrected, until the child day care license or registration has been revoked, or until the program successfully challenges OCFS’ decision to suspend.Įnforcement action is “pending” when a child day care program has been notified that OCFS is taking enforcement action. The enforcement action to revoke the license or registration is final, and the program may no longer operate. “Revoked” means OCFS took action to rescind the license or registration to operate the child day care program. “Renewal denied” means the application to renew the license or registration to operate the child day care program was denied, the license or registration was permitted to expire, and the enforcement action to deny the application of the program to renew the license or registration is final.
